Terms of Use — Adapt & Triumph

These terms are the agreement between you and Adapt & Triumph. By downloading or using the app, you agree to them. They are written to be read, not to be impressive. If something here is unclear, email us and ask.

The short version

Who can use the app

You must be at least 18 years old to use Adapt & Triumph. The app is intended for adults managing their own health and fitness, and it discusses medication, blood sugar, wound and scar care, and exercise loading in terms written for adults.

Health and medical disclaimer

Adapt & Triumph is not a medical device and does not provide medical advice, diagnosis, or treatment.

The workouts, calorie figures, meal guidance, pain and symptom information, and health content in this app are general educational information. They are not a substitute for the judgment of a qualified healthcare professional who knows your history.

Talk to your doctor, surgeon, prosthetist, physical therapist, or burn team before starting any exercise or nutrition programme in this app — particularly if you have diabetes, cardiovascular disease, an unhealed or recently healed wound or graft, a new or changing prosthetic fit, or any condition affected by exertion, heat, or dehydration.

Stop and seek medical attention if you experience chest pain, difficulty breathing, faintness, sudden or severe pain, a wound that opens or discharges, skin breakdown at a socket or graft site, or symptoms of very high or very low blood sugar. Do not wait to finish a session.

Calorie, macronutrient, hydration, and body-composition figures are estimates produced by formulas that adjust for limb loss. They are approximations, not measurements, and they can be wrong for you. Do not use them to make medication decisions — insulin dosing in particular. Those decisions belong with your care team.

The Emergency Card feature stores information you type in so you can show it to someone. It does not contact emergency services, does not notify anyone, and is not monitored. In an emergency, call your local emergency number. Do not rely on this app to summon help, and do not rely on it as your only record of your medical information.

Reminders are a convenience and are delivered by your phone's operating system on a best-effort basis. They can be delayed or missed — by battery optimisation, by the phone being off, or by a system setting. Do not rely on this app's reminders for medication timing.

Assumption of risk

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Physical exercise carries an inherent risk of injury, including serious injury, and in rare cases death. That risk is not removed by an exercise being described as adaptive, seated, low-impact, chair-based, or beginner. Risks include but are not limited to muscle and joint injury, falls, skin breakdown at a socket or graft site, overheating, dehydration, blood-sugar events, cardiac events, and aggravation of an existing condition.

By using the workouts, programmes, stretches, and activity guidance in this app, you knowingly and voluntarily assume all of those risks and accept full responsibility for your own safety.

You agree that you are responsible for:

To the fullest extent permitted by Oklahoma law, you release Adapt & Triumph from claims for injury or loss arising out of your own use of the app's fitness and nutrition content. This release does not apply to gross negligence, recklessness, or wilful misconduct, and it does not apply to anything that cannot lawfully be released.

Subscriptions and payment

Adapt & Triumph is free to use for a trial period that starts the first time you open it. The app always shows how many days you have left, and that counter is the accurate one — the length of the trial can change for new installs, but it never shortens for a trial already running. After the trial, continued access requires a paid plan.

Cancelling. We cannot cancel your subscription for you — the billing relationship is between you and Apple or Google. Cancel in your store account settings. The app links you straight there. When you cancel, access continues to the end of the period you have already paid for.

Refunds are handled by the store under its own policy, not by us. If a store declines a refund you believe you are owed, email us anyway and we will help where we can.

Buying Lifetime while a subscription is running does not cancel the subscription. They are different product types and the store keeps billing the subscription until you cancel it yourself. The app warns about this before and after the purchase, but the responsibility for cancelling is yours.

Sponsored access

Some people receive access through a clinic, manufacturer, charity, or other sponsor rather than by paying. Sponsored access grants full use of the app for a fixed term that begins when the code is redeemed. It is not a subscription, does not renew, and does not charge you anything. When the term ends, you can choose a paid plan or contact us.

Sponsor codes are issued to organisations for distribution to the people they serve. They are not for resale, and we may retire a batch of codes that is being distributed outside its intended purpose.

If you cannot afford it

Email us. We would rather you keep using the app than lose it over the price. This is a real offer and it is in these terms so that it is not something you have to hope for.

Your content and your data

What you enter — workouts, meals, weights, photos, journal entries, medical notes — is yours. It stays on your device. We do not collect it, cannot read it, and do not sell it. The privacy policy sets out the detail, including the few third parties involved in purchases and app updates.

Because your data lives on your device, you are responsible for backing it up. The app includes a backup and restore feature. If you lose or reset your phone without a backup, we cannot recover your history for you — there is no copy of it anywhere else.

Intellectual property

The app, its content, and its name belong to Adapt & Triumph. You get a personal, non-transferable licence to use the app for your own health and fitness. That licence ends if these terms end.

No warranty

The app is provided "as is" and "as available", without warranties of any kind. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the app will be uninterrupted, error-free, or available at any particular time, that its calculations will be accurate for you, or that reminders will be delivered. It is software on a phone you own, and phones fail.

Limitation of liability

To the fullest extent permitted by law, Adapt & Triumph is not liable for any injury, illness, death, loss of data, lost profits, or any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the app — including from following any workout, stretch, calorie or macro figure, meal guidance, or health information in it, and including any failure or delay of a reminder.

Where liability cannot lawfully be excluded, our total liability to you for all claims combined is limited to the greater of the amount you paid for the app in the twelve months before the claim, or twenty US dollars.

This limit applies even if a remedy fails of its essential purpose, and it applies to every theory of liability — contract, tort, negligence, strict liability, or otherwise.

Nothing in these terms limits liability for gross negligence, recklessness, wilful misconduct, fraud, or anything else that cannot lawfully be limited. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you, and you may have rights that these terms cannot take away.

Indemnity

If someone brings a claim against us because of how you used the app — for example because you used its content to advise or train another person, or because you forged or resold access codes — you agree to cover the resulting costs, to the extent the law allows.

Apple and Google

These terms are between you and Adapt & Triumph, not with Apple or Google. Apple and Google are not responsible for the app or its content and have no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Ending these terms

You can stop using the app at any time by deleting it. We may end your access if you breach these terms, in which case any unused paid period will be refunded on a pro-rata basis unless the breach involved forged or resold access codes.

Changes to these terms

If these terms change in a way that materially affects you, the app will tell you before the change takes effect. Continuing to use the app after that means you accept the new terms. The effective date at the top of this page always reflects the current version.

If there is a dispute

Email us first. Almost everything is a misunderstanding about billing or access, and we would rather fix it than argue about it. Give us 30 days to put it right before starting anything formal. Most problems are solved the same week.

Either of us may bring a claim in small claims court instead, and nothing here stops you from doing that.

Governing law

These terms are governed by the laws of the State of Oklahoma, United States, without regard to conflict-of-law rules, and any dispute not resolved informally will be brought in the state or federal courts located in Oklahoma.

If you live somewhere else, nothing here removes the consumer protections you have under the law of your own state or country, and you may be entitled to bring a claim locally regardless of this section.

Severability and the whole agreement

If any part of these terms is found unenforceable, that part is limited or removed to the smallest extent necessary and the rest stays in force. If we do not enforce something immediately, we have not given up the right to enforce it later.

These terms and the privacy policy are the whole agreement between you and Adapt & Triumph about the app, and replace anything said before.
